Terms of Use — Mamastops app

This document covers the Mamastops app. Other Mamastops terms:

1. About these terms

These Terms of Use govern your use of the Mamastops app for Android and iOS, published under the identifier com.mamastop.app, and of the Mamastops services the app connects to.

The app serves two kinds of user. Drivers use it on the road to carry out assigned trips and redeem services at partner stations. Customer teams use it to place and manage orders away from a desk. You sign in the same way either way, and the home screen you land on follows your role. Sections that apply to only one role say so.

They sit alongside the Mamastops Terms of Service and the commercial agreement between Mamastops and the organisation you work for. Where these terms and that agreement conflict on the same point, the commercial agreement prevails.

By downloading, installing, or using the app you accept these terms. If you do not accept them, do not use the app.

2. Who may use the app

The Mamastops app is a business tool. It is not available to consumers or to the general public, and it has no self sign-up — an account only works once Mamastops has issued it. You may use the app if you are at least 18 years old and you are either:

  • a licensed commercial driver holding a valid, current driving licence for the vehicle you operate, onboarded by a transporter, provider, or customer that subscribes to Mamastops services; or
  • an authorised user of a customer organisation that subscribes to Mamastops services, acting within whatever authority that organisation has given you.

3. Your organisation controls your access

Your organisation decides who is given an account, what each account may do — including what a user may order and up to what value — and when access ends. It may suspend or remove your access at any time, without notice to you from us. Trips, consignments, and the services a driver may redeem are assigned by that organisation.

4. Your account and sign-in

You sign in with the mobile number registered to your account, using a one-time password (OTP) delivered over WhatsApp, with SMS as a fallback.

  • Never share an OTP with anyone, including anyone claiming to be from Mamastops. We will never ask you for one.
  • Do not share your account or let anyone else act under your session.
  • You are responsible for everything done under your account.
  • Tell us at support@mamastops.com immediately if you lose your phone or believe your account has been accessed without your permission.
  • Keep the information on your profile accurate and current.

5. Licence and permitted use

Subject to these terms, Mamastops grants you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use the app on a device you control, for your organisation's business purposes, for as long as your account remains active. No other rights are granted.

6. Placing and managing orders

Where your role allows it, the app lets you place orders, follow their status, view wallet balances, and track consignments in transit. When you use those features:

  • an order you place is placed on behalf of your organisation and commits its funds, not yours — make sure you are authorised before you confirm one;
  • an order is only accepted once it is confirmed in the platform. Submitting one does not by itself guarantee capacity, a price, or a delivery date;
  • wallet balances, order statuses, and consignment positions are shown as at the last update our systems received. They may lag reality, and are indicative rather than a statement of account — the platform record and your invoices govern;
  • changing or cancelling an order after it has been accepted is subject to your organisation's agreement with us, and work already performed remains chargeable; and
  • you must not place an order you know your organisation cannot fund or does not want.

7. Cashless services at partner stations (drivers)

The app lets a driver redeem fuel, parking, tolls, border clearance, and other services at Mamastops partner stations by scanning a QR code. When you do:

  • the value is drawn from a wallet funded by the organisation you drive for, not from your own funds, and it remains that organisation's money;
  • you may redeem only what has been authorised for the trip you are on, and only for the vehicle and consignment it was authorised for;
  • you may not exchange a redemption for cash, resell it, transfer it to another person or vehicle, or redeem on behalf of anyone else;
  • the goods or services themselves are supplied by the partner station, not by Mamastops. Disputes about the quality or quantity supplied are between that station and the organisation you drive for, though we will help where we can; and
  • fuel is authorised as a hold at the platform rate and finally charged at the actual quantity dispensed and the actual pump rate on reconciliation, so the final amount may differ from the amount shown at the time of the hold.

Attempting a fraudulent redemption is a serious breach of these terms. We will suspend the account, inform the organisation you drive for, and report it to the authorities where the law requires it.

8. Location and route information

While the app is open, it attaches your current GPS position to authenticated requests so that dispatch and partner stations can confirm a truck's position relative to the planned route and verify QR-redeemed services. The app does not request background location permission and cannot track you when it is closed. How this data is handled is set out in the Privacy Policy.

You must not falsify, spoof, or otherwise interfere with the location the app reports.

9. Safe use while driving

Do not use the app while the vehicle is moving. Stop safely and legally before interacting with it. You remain solely responsible for driving safely and for complying with all road-traffic, transport, and cross-border laws that apply to you. The app does not provide navigation or driving instructions, and nothing it displays overrides a road sign, an official instruction, or your own judgement.

10. Acceptable use

You must not:

  • submit false, forged, or misleading information, documents, orders, or proof of delivery;
  • act beyond the authority your organisation has given you, or use another person's account or role;
  • reverse engineer, decompile, disassemble, or attempt to derive the source code of the app, except to the extent that applicable law expressly permits it;
  • access the Mamastops APIs other than through the app, or run automated or bulk requests against them;
  • probe, scan, or test the security of the service, interfere with its operation, or attempt to gain unauthorised access to any account, system, or data;
  • remove or obscure any proprietary notice, or use the Mamastops name, logo, or marks without permission; or
  • use the app in breach of any applicable law.

11. Availability and changes

We aim to keep the app available, but we do not guarantee uninterrupted access — cross-border routes include areas with no mobile coverage. We may suspend the service for maintenance or updates, or where circumstances outside our control require it, and we may add, change, or withdraw features. Your mobile carrier's data and roaming charges are your own. We may require you to update to a supported version of the app to keep using it.

12. Intellectual property

The app, the Mamastops platform, and everything in them — software, design, text, and marks — are owned by Mamastops or its licensors and are protected by intellectual-property law. Your organisation keeps ownership of its own order, consignment, and operational data. Nothing in these terms transfers ownership of anything to you.

13. Suspension and termination

Your access to the app ends when:

  • your organisation removes your account or its subscription ends;
  • you delete your account — see How to delete your account in the Privacy Policy; or
  • we suspend or terminate your access because you have breached these terms or because we reasonably suspect fraud, misuse, or a security risk.

On termination the licence in Section 5 ends and you must stop using the app. Orders already accepted, and services already redeemed, remain payable. Sections 6, 7, 10, 12, 14, and 17 survive termination.

14. Disclaimers and limitation of liability

To the maximum extent permitted by law, the app is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, Mamastops is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, use, or goodwill, arising out of or connected with your use of the app — including any loss arising from a partner station being unavailable, a redemption failing, a balance or status displayed out of date, or a delay in the delivery of a one-time password or notification.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

15. Privacy

Our handling of personal data in the app is described in the Mamastops Privacy Policy, which forms part of these terms.

16. App stores and changes to these terms

The app store you obtained the app from is not a party to these terms, has no obligation to provide support for the app, and is not responsible for any claim relating to it. Your use of the app must also comply with that store's own terms. Apple Inc. and its subsidiaries are third-party beneficiaries of these terms in respect of the iOS app and may enforce them against you.

We may update these terms when the app or our services change. The current version is always at https://www.mamastops.com/terms/app, and the Last updated date at the top tells you when it took effect. Material changes will also be announced inside the app the next time you log in. Continuing to use the app after a change means you accept the updated terms.

17. Governing law

Mamastops contracts through a local entity in each country where it operates. These terms are governed by, and construed in accordance with, the laws of the country of the Mamastops entity that provides your services, without regard to its conflict-of-law provisions:

  • MAMASTOP LOGISTICS SOLUTIONS LIMITED — the laws of the Republic of Zambia.
  • Mamastops Logistics Solutions Tanzania Ltd — the laws of the United Republic of Tanzania.
  • Mamastop Logistics Solutions Ltd — the laws of the Republic of Rwanda.
  • Mamastops Logistics Solutions South Africa (Pty) Ltd — the laws of the Republic of South Africa.
  • Mamastop Logistics Solutions LDA — the laws of the Republic of Mozambique.

Where the services are provided by more than one entity, or where the responsible entity is not otherwise clear, these terms are governed by the laws of the Republic of Zambia and the courts of Lusaka, Zambia have jurisdiction. Nothing in this clause removes any right you have under the mandatory consumer or data-protection law of your own country.
