Terms of Use — Mamastops Radar

This document covers the Mamastops Radar app. Other Mamastops terms:

1. About these terms

These Terms of Use govern your use of the Mamastops Radar app for Android and iOS, published under the identifier com.mamastops.radar, and of the Mamastops services the app connects to.

They sit alongside the Mamastops Terms of Service and the commercial agreement between Mamastops and your organisation. Where these terms and that agreement conflict on the same point, the commercial agreement prevails.

By downloading, installing, or using Radar you accept these terms. If you do not accept them, do not use the app.

2. Who may use Radar

Radar is a business application. You may use it only if:

  • you are an authorised user of an organisation that subscribes to Mamastops services;
  • that organisation has issued or approved your Radar account; and
  • you are at least 18 years old.

Radar is not available to consumers or to the general public, and self-registration is not offered.

3. Your organisation controls your access

The fleet, vehicle, and operational data shown in Radar belongs to your organisation, not to you. Your organisation decides who is given an account, what each account can see, and when access ends. It may suspend or remove your access at any time, without notice to you from us.

Your organisation is responsible for how it uses vehicle tracking data, including telling its drivers that their vehicles are tracked and meeting any employment and data-protection obligations that follow from that.

4. Accounts and credentials

Radar supports sign-in with an email address and password, and — where your organisation has enabled it — with Microsoft single sign-on.

  • Keep your credentials confidential and do not share your account with anyone else.
  • You are responsible for everything done under your account.
  • Tell us at support@mamastops.com immediately if you believe your account has been accessed without your permission.
  • Log out of the app on any device you no longer control.

5. Licence and permitted use

Subject to these terms, Mamastops grants you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use Radar on a device you control, for your organisation's internal fleet-management purposes only, for as long as your organisation's subscription and your account remain active. No other rights are granted.

6. Acceptable use

You must not:

  • use Radar to access fleet or vehicle data your organisation has not authorised you to see, or to monitor any individual for a purpose your organisation has not authorised;
  • copy, export, resell, or otherwise disclose fleet data to a third party outside your organisation without its permission;
  • reverse engineer, decompile, disassemble, or attempt to derive the source code of the app, except to the extent that applicable law expressly permits it;
  • access the Mamastops APIs other than through the app, scrape them, or run automated or bulk requests against them without written permission;
  • probe, scan, or test the security of the service, interfere with its operation, or attempt to gain unauthorised access to any account, system, or data;
  • remove or obscure any proprietary notice, or use the Mamastops name, logo, or marks without permission; or
  • use Radar in breach of any applicable law, sanction, or export-control rule.

7. Accuracy of fleet information

Radar displays information reported by tracking hardware fitted to vehicles and relayed through mobile networks and third-party platforms. Positions, speeds, odometer readings, fuel levels, ignition states, and alerts are therefore indicative and may be delayed, incomplete, or inaccurate — for example where a device loses power or GPS fix, where mobile coverage is unavailable, or where an upstream provider is degraded.

Radar is a management and monitoring tool. It is not a safety, emergency, security-response, or navigation system, and must not be relied on as the sole basis for a decision affecting the safety of any person or cargo, nor as legal evidence of a vehicle's position at a given time.

8. Availability and changes

We aim to keep Radar available, but we do not guarantee uninterrupted access. We may suspend the service for maintenance or updates, or where circumstances outside our control require it, and we may add, change, or withdraw features. Using the app needs a working internet connection and a supported version of Android or iOS; your mobile carrier's data charges are your own. We may require you to update to a supported version of the app to keep using it.

9. Intellectual property

The Radar app, the Mamastops platform, and everything in them — software, design, text, and marks — are owned by Mamastops or its licensors and are protected by intellectual-property law. Your organisation keeps ownership of its own fleet and operational data. Nothing in these terms transfers ownership of anything to you.

10. Suspension and termination

Your access to Radar ends when:

  • your organisation removes your account or its subscription ends;
  • you ask us to delete your account; or
  • we suspend or terminate your access because you have breached these terms or because we reasonably suspect fraud, misuse, or a security risk.

On termination the licence in Section 5 ends and you must stop using the app. Sections 6, 7, 9, 11, and 14 survive termination.

11. Disclaimers and limitation of liability

To the maximum extent permitted by law, Radar is provided "as is" and "as available", without warranty of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, Mamastops is not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, use, or goodwill, arising out of or connected with your use of Radar — including any loss arising from reliance on delayed, incomplete, or inaccurate fleet information as described in Section 7.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or for fraud.

12. Privacy

Our handling of personal data in Radar is described in the Mamastops Radar Privacy Policy, which forms part of these terms.

13. App stores

Radar is distributed through Google Play and the Apple App Store. Those stores are not parties to these terms, have no obligation to provide support for Radar, and are not responsible for any claim relating to it. Your use of the app must also comply with the terms of the store you obtained it from. Apple Inc. and its subsidiaries are third-party beneficiaries of these terms in respect of the iOS app and may enforce them against you.

14. Changes to these terms

We may update these terms when the app or our services change. The current version is always at https://www.mamastops.com/terms/radar, and the Last updated date at the top tells you when it took effect. Continuing to use Radar after a change means you accept the updated terms.

15. Governing law

Mamastops contracts through a local entity in each country where it operates. These terms are governed by, and construed in accordance with, the laws of the country of the Mamastops entity that provides your services, without regard to its conflict-of-law provisions:

  • MAMASTOP LOGISTICS SOLUTIONS LIMITED — the laws of the Republic of Zambia.
  • Mamastops Logistics Solutions Tanzania Ltd — the laws of the United Republic of Tanzania.
  • Mamastop Logistics Solutions Ltd — the laws of the Republic of Rwanda.
  • Mamastops Logistics Solutions South Africa (Pty) Ltd — the laws of the Republic of South Africa.
  • Mamastop Logistics Solutions LDA — the laws of the Republic of Mozambique.

Where the services are provided by more than one entity, or where the responsible entity is not otherwise clear, these terms are governed by the laws of the Republic of Zambia and the courts of Lusaka, Zambia have jurisdiction. Nothing in this clause removes any right you have under the mandatory consumer or data-protection law of your own country.
